RULES AND CONDITIONS

VERY IMPORTANT : One week before your entrance to the house you will have to contact Martina, who is the housekeeper and in charge of the maintenance of the house. By Whatsapp or phone at +34 681 96 95 74 . She speaks Spanish, French and English. She is the person to contact for any management during your stay. She will welcome you to the house to welcome you and give you the keys as well as to finalize your reservation.

OBLIGATORY SCHEDULE : Arrival time is at 16:00 hrs and departure time is at 10:00 hrs.

CONTRACTUAL CONDITIONS

FIRST - DEPOSIT
On the day of the reception of the keys and after an inspection of the rented accommodation together with Martina, the tenant must pay her 200,00€ in cash as a security deposit for the rental. The deposit will be refunded on the last day of the rental, after both parties have checked that the property has not suffered any damage or damage during the rental period.
On the other hand, the tenant must pay a final cleaning deposit of 70,00€ in cash, which will be returned at the end of the stay as long as it is verified that the cleaning is as expected:

  • Tidy house
  • Toilets clean
  • Clean and mopped floors
  • Clean countertops
  • Beds unmade and sheets, kitchen towels, soiled towels collected in the living room minus mattress covers (only soiled linen)
  • Clean bed linens and towels tidy in closets (if not all linens have been used)
  • Dishwasher and sink empty and clean dishes put away and tidy.
  • Empty and clean garbage and waste garbage cans
  • Clean ashtrays
  • Cigarette butts and pet waste picked up
  • Netflix / Youtube accounts on the TV set removed

SECOND - TENANT'S OBLIGATIONS
The tenant declares to have carried out the inspection of the rented property, verifying that it is in perfect condition and committing himself/herself to:
- keep the property in perfect condition during the rental period stipulated by both parties,
- to make appropriate and reasonable use of the means of comfort made available to him (heating, air conditioning, etc.) and of the appliances and furniture in the dwelling,
- to notify the owner, as soon as possible, in case of breakdown, damage or accident that may occur in the apartment during their stay,
- not to cause any nuisance to the neighbors,
- and to respect the internal rules of the house.
The tenant may not make any copy of the keys of the rented house. Only one set of keys will be given to the tenant. Any mismanagement of the keys will be the tenant's responsibility.

THIRD.- OBLIGATIONS OF THE OWNER
The landlord undertakes to:
- to carry out, himself or through an intermediary, the inspection of the rented accommodation together with the tenant to verify the state of the same on the first and last day of the rental,
- deliver the accommodation in a perfect state of use, habitability, cleanliness and safety,
- to leave the electricity, gas and water supply in perfect working order, and to expressly indicate to the tenant whether or not their use is included in the rental price, as indicated in the third clause of this contract,
- repair, in the shortest possible time, any possible breakdown or malfunction of the domestic equipment essential to the tenant's comfort,
- to ensure that the tenant can enjoy a comfortable environment during his stay, avoiding disturbing his peace of mind during the rental period of the rented dwelling.

FOURTH - NUMBER OF OCCUPANTS

The dwelling mentioned in the first point of the expository part of the present contract is rented by the owner to a maximum number of 6 persons. The tenant agrees not to exceed this number of persons without the express authorization of the owner. 

FIFTH.- PETS

The presence of pets in the rented property must be expressly authorized by the owner. Pets are accepted as long as their owners are responsible for cleaning up after them, even outdoors, prevent them from climbing on sofas, armchairs, beds and furniture and avoid acoustic disturbances. 

SIXTH - ASSIGNMENT AND SUBLETTING

Subletting, total or partial, as well as the transfer of the rented dwelling by the tenant is strictly forbidden. Failure to comply with this clause shall be cause for termination of this contract.

SEVENTH.- CANCELLATION

The tenant who unilaterally cancels the rental contract will not be able to request the reimbursement of the amounts already paid to the owner. 

If the owner unilaterally cancels the rental contract for any reason other than the tenant not respecting the clauses of this contract, he shall reimburse the tenant the deposit paid or the total amount of the rent already paid, in the shortest possible time, if it is a case of force majeure that makes the rental of the apartment not possible.

EIGHTH.- CONTACT, GARDEN, SWIMMING POOL, HOUSEHOLD GOODS AND CLEANING

Once the contract is signed as well as all the formalities with the owner, the lessor undertakes to contact Martina on +34 681 96 95 74 for any on-site management. 

The pool is maintained by an assigned professional. It is equipped with an automatic system that works at night. Any anomaly or problem detected must be reported to Martina. Please use the outside shower before entering the pool to wash off cream, oil, sand and any other element that could be a danger to the pool pump. The pool attendant has access to the plot and usually comes in early on weekends to clean the pool.

The sheets, bath towels, pool towels, kitchen towels (one set of each available per week) and all the necessary kitchenware are at the renter's disposal as well as all the electricity, water and gas expenses are included.

The barbecue is at the disposal of the lessor. Its maintenance and cleaning are therefore at his charge. 

The cleaning of the house is not included in the contract. The landlord undertakes to return the house in the same conditions as at the entrance to the accommodation. Dirty sheets and towels will be left at Martina's expense. 

In addition, the owner, through Martina, undertakes to clean and disinfect the house after each rented stay. 

NINTH - TERMINATION 

In case of non-compliance with the clauses of this contract by both parties, this contract will be terminated with full right, without the right to any indemnification by both parties.

TENTH.- APPLICABLE LAW

The parties submit to the jurisdiction and competence of the courts and tribunals of the place where the rented property is located. 

The laws of Spain are applicable and specifically the current Urban Lease Law.
